Top Things to know about ICBC Benefits

Have you been injured in a car accident, motorcycle accident, bicycle accident or as a pedestrian?  Do you have an ICBC claim in Surrey, Langley or anywhere else in the Lower Mainland or Fraser Valley?  You should know that when you have suffered a personal injury, ICBC has a legal duty to provide you various rehabilitation benefits, and possibly wage loss benefits too.  These are benefits you have paid ICBC for under your own vehicle insurance.

Generally, when you an injured in a car accident, you are not at fault and you make an ICBC claim, ICBC represents the at-fault driver under the at-fault driver’s liability insurance.  However, ICBC also is your insurance company under your Autoplan coverage, and the benefits you have purchased as part of your vehicle insurance include payment towards rehabilitation and possible for income indemnity.  ICBC calls these benefits “Accident Benefits”, but the benefits are also known as “Part 7” or “No Fault” benefits.

These ICBC benefits provide a basic level of coverage for such things as physiotherapy, massage therapy or chiropractic treatments, and ICBC usually provides very basic coverage.  However, injured people are often entitled to more therapy than ICBC offers, and there are also many other treatments available to injured people. The additional benefits could include payment for prescription medications, kinesiologists, occupational therapists, and gym passes, amongst other rehabilitation options.

Unfortunately, these Part 7 benefits do not cover the entire cost of treatment, often resulting in an injured person having to pay what is called a “user fee”. For example, ICBC may only pay $23 towards the cost of a treatment, with the injured person having to pay $25 – $35, or more, per session.  These costs can really add up, especially if you need to attend 2 or more sessions per week.

At Hamilton Duncan, we have the knowledge and experience to review your rehabilitation needs and options with you to ensure you receive the appropriate treatments when you are hurt.  This means dealing with ICBC to obtain the full range of Part 7 benefits available to you by law.

More importantly, Hamilton Duncan has the financial resources to assist in funding for your rehabilitation.  Generally, if you are not at fault, Hamilton Duncan can cover up to $3,000 in user fees to assist your rehabilitation once all other options are exhausted.
